Declaration

One of two important documents included in the Prospectus, (the second is the statement of Bylaws) the Declaration of Covenants, Conditions, Easements and Restrictions is the overall governing document controlling the rights and responsibilities of each homeowner and the Association.  It creates easements and rights for each unit owner.  It also establishes certain restrictions on unit owner rights which are binding on every unit owner and their successors and assigns.   
 
The initial Declaration went into effect in 2001 and has a term of 30 years with automatic 10 year extensions.  It can only be modified during its initial term by a vote of 90% of the members and thereafter by a vote of 75% of the members.  There were short Supplements filed with the establishment of Phases II and III and the “additional property” (located along the east side of Maryland Rd. north of Baltimore Way) which added the homes of each new phase and made generally minor other additions to the original document.
